Conveyancing Solicitors - The Stages a Conveyancing Solicitor Completes During a Typical Freehold Sale

Below is a guide to a typical freehold house sale and the processes that a conveyancing solicitor will go through. If you are at all confused or slightly bewildered by the concept of conveyancing, or why you need conveyancing solicitors, then this guide should help.
Step 1, Finding and Instructing Your Conveyancing Solicitors
Firstly begin by doing a bit of research on the different conveyancing solicitors you are interested in. Once you’ve done your research and are happy with your choice of conveyancing solicitor, instruct your solicitor on your sale. Your conveyancing solicitor will send you an instruction pack which you are then required to complete and send back.
Your instruction pack will contain a Fixtures and Fittings form and a Sellers Leasehold Information Pack. Complete these forms as best you can and if you’re having any difficulties, don’t hesitate to contact your conveyancing solicitor. Once the forms are complete send them back with any building work guarantees or planning permissions you may have.
Step 2, Preparing Your Conveyancing
Your conveyancing solicitor will now obtain all the main forms and documents including your Title Deeds and Land Registry Office Copies. Once you have instructed your conveyancing solicitors they will begin preparing a draft contract and compile a contract pack to send to your buyer’s conveyancing solicitor.
Step 3, Conveyancing Negotiation
Your conveyancing solicitor will answer questions from your buyer’s conveyancing company, (mainly about the compiled contract pack). Your conveyancer will also be getting confirmation that your buyer’s mortgage application has been approved. As a client, you should be aware that the more helpful you are in answering any questions form your conveyancer, the more smoothly your case will progress. Once this is all complete your conveyancer will send you the finalised contract. So long as you are happy with the contract sign it and send it back to your conveyancing solicitor. Once these steps have been performed your conveyancing solicitor will swap the signed contracts with your buyer’s solicitor and collect and hold your buyer’s deposit. You are now legally committed to the sale of your property.Step 4, Finalising Your Conveyancing
Your conveyancing solicitor will confirm a settlement figure with your lender for the deliverance of your current mortgage, with you overseeing the duty. Once that is done your conveyancing solicitor will receive the Transfer Deed which they will then check over and forward to yourself. Once you receive the transfer deed you should sign it and return it as quickly as possible.
Step 5, Conveyancing Completion
From here your conveyancer will receive all the monies from your buyer or buyer’s mortgage lender via the buyer’s conveyancing solicitor. Your solicitor will also send on the title deeds and transfer deeds to the buyer’s solicitor, and once these are confirmed actions the conveyancer will pay itself, your estate agent and other unsettled fees owed to your current mortgage lender.
Now the sale is complete and you can vacate the premises, dropping the keys off at your estate agents for the buyer to collect. Your conveyancer will then follow up any other paperwork and register the new owner of your property at H.M. Land Registry.
