in order to negotiate a settlement. If this does not result in the

an excellent track record in settling cases at all stages be it
at the start or winning at trial), the next step is to consider
whether an alternative dispute resolution method such as mediation
or arbitration is suitable.
Mediation is a relatively informal process involving the appointment
of an independent mediator to explore both parties’ cases
and endeavour to achieve a settlement. The process will typically
take a day of everyone’s time but if it resolves in the claim
settling, it is time well spent given that it saves the energy and
expense of pursuing a matter through the court.
If all else fails, the court is usually the option of last resort.
Remember, once a claim is issued, it can be diificult to stop. The
costs of litigating a claim can be high. At Arc Property Solicitors
LLP, we will always give you our best costs estimate at the start
of any case we take on. However, it is not easy to provide accurate
estimates at the start of the claim as it is often uncertain as
to how a claim will proceed.
